However, everyone reading this should know that there’s legislation currently pending in the Senate which could make a lot of side hustles like this basically illegal, or at least a lot more difficult to do legally. The PROACT (“protecting the right to organize”) contains a provision that means anyone paying you needs to pay you as an employee, which includes not only payroll taxes but also deductions for unemployment insurance, workers compensation insurance. We just fought a very similar law in California (AB5) and if the PROACT passes it will be a nightmare scenario for anyone who doesn’t like or want to have a normal 9 to 5 job in an office.
